El 23 de febrero de 2013,  Néstor Reverol, ministro para las Relaciones  de Interiores y Justicia  informó que su despacho investiga un "presunto plan desestabilizador a través de las redes sociales", como Twitter. Estas declaraciones fueron ofrecidas durante un acto oficial, en el estado Zulia, al occidente del país. 

El 23 de febrero de 2013,  Néstor Reverol, ministro para las Relaciones  de Interiores y Justicia  informó que su despacho investiga un "presunto plan desestabilizador a través de las redes sociales", como Twitter. Estas declaraciones fueron ofrecidas durante un acto oficial, en el estado Zulia, al occidente del país.

Esta amenaza de acción legal fue generalizada y no se señaló a posibles responsables. Además, surgió luego de una ola de rumores en Twitter ante un supuesto plan de insurrección en Fuerte Tiuna, sede de las Fuerzas Armadas Bolivarianas, principal cuerpo militar del Estado, ubicada en Caracas, Distrito Capital. Los rumores surgirían ante la ausencia, a nivel público, del Presidente de la República, Hugo Chávez, quien desde el mes de diciembre se encuentra en un proceso clínico de recuperación tras haber sido intervenido por la aparición de células cancerígenas.

Reverol señaló las investigaciones se adelantan a través de división de investigaciones electrónicas del Cuerpo de Investigaciones Penales y Criminalísticas (CICPC), órgano de la policía científica.  "No vamos a permitir hechos de desestabilización. Candela que prendan, candela que vamos a apagar, porque no vamos a permitir ningún tipo de desestabilización", afirmó el ministro.

Estas declaraciones configuran una amenaza de acción legal que pudiese afectar la libertad de expresión e información a través de las redes sociales. Además, se motivar el inicio de procedimientos sancionatorios contra medios de comunicación, establecidos en la Ley de Responsabilidad Social en Radio, Televisión y Medios Electrónicos. Asimismo, estas amenazas pueden generar censura  de contenidos, así como autocensura de difusión de informaciones y opiniones sobre hechos de interés colectivo.

Executive power to investigate "destabilizing messages" sent through Twitter

On February 23, 2013, Néstor Reverol, minister of interior and justice, informed that his office is investigating an "alleged destabilizing plan through social networks" such as Twitter. These declarations were offered during an official event in Zulia state, on the western part of the country.

This threat of legal action was a general one and no possible responsible parties were mentioned. It came about after a wave of rumors on Twitter of an alleged insurrection plan at Fuerte Tiuna, the headquarters of the Bolivarian armed forces, the state´s principal military corps, located in Caracas, Capital district. The rumors arose due to the public absence of the president of the republic Hugo Chávez, who is in recovery since last December after undergoing a surgical intervention to treat the recurrence of cancer cells.

Reverol stated that the investigations are carried out through an electronic investigation division of the Penal and Criminalistic Investigations Corps (CICPC), an entity of the scientific police force.  "We are not going to permit destabilizing events to take place. Whatever fire they light is a fire we will put out, because we are not going to permit any destabilizing ruse", the minister affirmed.

These declarations constitute a threat of legal action which could affect the freedom of expression and information through social networks. It also prompted the start of sanction-based proceedings against the media, as per the Law on Social Responsibility in Radio, Television and Electronic Media. These threats could also generate the censorship of content and self-censorship in the dissemination of information and opinions on events of collective interest.
